JinkoSolar Sues Waaree Energies Over Alleged TOPCon Patent Infringement

JinkoSolar has filed a patent infringement lawsuit against Waaree Energies and its US subsidiary Waaree Solar Americas in the US District Court for the Southern District of Texas. The lawsuit alleges that Waaree has violated JinkoSolar’s n-type tunnel oxide passivated contact (TOPCon) patent, US11,824,136B2.

Details of the Dispute

Waaree Energies, India’s largest solar PV module manufacturer, operates four PV manufacturing plants in Gujarat with a combined capacity of 12 GW. Its US arm, Waaree Solar Americas, began production at its 1.6 GW plant in Brookshire, Texas, in December 2024. JinkoSolar’s disputed patent, granted in 2023, covers solar cells, manufacturing methods, and photovoltaic modules.

JinkoSolar’s Global Patent Defense

JinkoSolar has been actively defending its intellectual property, filing multiple patent infringement cases globally. In December 2024, it sued VSUN Solar, a subsidiary of Japan’s Fuji Solar, in the US. It also filed lawsuits against LONGi in China, Japan, and Australia in early 2025.

Awaiting Response

As of press time, Waaree Energies has not responded to requests for comment. The lawsuit highlights the increasing competition and legal battles in the global solar industry as companies strive to protect their technological advancements.
